Today FDA announced publication of the final two food safety proposed
regulations required by the Public Health Security and Bioterrorism
Preparedness and Response Act of 2002 ("The Act"). There are a total of
four proposed regulations to the Act which gave FDA new authority to
protect the nation's food supply.
Today's two proposals deal with establishing and maintaining records
(section 306) among food firms, and the administrative detention (section
303) of foods that may pose a risk to public health. The other two
proposals, concerning the registration of food facilities (section 305)
and prior notice of imported foods (section 307), were published in
January 2003.

On May 7 from 1-3 pm (EDT) the U.S. FDA is sponsoring a satellite downlink
public meeting on: Administrative Detention (section 303) and
Establishment and maintenance of records (section 306). FDA will discuss
the proposed regulations implementing Title III of the Public Health
Bioterrorism Preparedness and Response Act of 2002. This broadcast will
focus on the proposed rules pertaining to the establishment and
maintenance of records for persons that manufacture, process, pack,
transport, distribute, receive, hold or import food (farms and restaurants
are exempt). There will also be a discussion on administrative detention
which authorizes FDA to administratively detain food if the agency has
credible evidence or information that the food presents a threat to humans
or animals.
There will be a playback session on May 9, 6:00-8:00 am EDT, for South
Africa.
Also on May 9, 9:00-11:00 am EDT, there will be a playback session for
Western Europe.
On May 12, 4:00-6:00 UTC/GMT, there will be a playback session for Japan,
Australia, and parts of Asia.
