I am trying to help an attorney in my office with research on Massachusetts rules of evidence. She has come across "MA proposed rule of evidence 702" but we can not find the text of such a rule for Massachusetts. I have also come across "MPS vol. 19 Hughes, Evidentiary standard 702" but I can not locate this either. Essentially the question boils down to which (if any) section of the MA statutes deals with admissibility of expert testimony as evidence. Does Massachusetts have a binding code of evidence?
If any of my colleagues in Massachusetts can help me with any of this I would be grateful. Please reply to me privately. Thanks!
