You no longer need to obtain the permission of West to copy cases from
their case reporters as long as you first block out the headnotes etc. --
see HyperLaw v. West -- cert. was denied last week by the U.S. Supreme Court.
You are now free to copy the law without regard to the monopolistic claims
of West Publishing Company -- but wait -- West is seeking to obliterate
this holding by pushing through special interest database protection
legislation -- which would appear to apply to databases in the form of
printed books like the West Reporters. In fact, that is the whole point of
the proposed database protection legislation.
