Many universities have adopted copyright and fair use guidelines.
Copyright and Fair Use: A Guide for the Harvard Community, issued by the
Harvard University Office of the General Counsel, is on the Internet.
Sorry I don't have the URL.

Re fair use, the Guide points out that the publishing industry has
promulgated "Guidelines for Classroom Copying." There are also on the
Internet. The Guidelines specify just what an instructor can copy for
course handouts without permission of the copyright holder. These
Guidelines are also on the Internet.

In addition, I have seen information on the Internet about what can be
included in "Course Packs," and the Copyright Clearance Center
<www.copyright.com> has an Academic Reporting Service.

Ultimately, I believe the General Counsel at the university where the
question arose will need to be the arbiter of what that particular
instructor does.
