You have some mighty sharp and very cool law librarians at your university
and in San Diego. Have you spoken to them?

You also neglected to let us know where you have already looked to find
articles. For example, have you checked print, or online indexes, legal,
social science, or other indexes? Have you searched some of the mega legal
indexes on the Web? What are the names of the databases and indexes you
have checked? Have you looked at any of the indexes to library, academic,
and publishing literature?

Your topic is one dear to our hearts and I'm sure we could all come up
with some additional research sources, but there isn't any need to
duplicate your research.

Willing and able to help, but need a bit more info from you before
embarking,

obtain) the 1998 World Almanac and Book of Facts? Our
Library never received this particular edition, and we would
still like it for reference purposes. I have checked with
the publisher, but they only sell the 1999 edition.

Following is a summarization of my question to you Librarians as to how this is done at other libraries..........

1. In-house messengers go to outside libraries and retrieve and copy or just retrieve needed materials. - 3

2. Use the Outside Library's Copy and Retrieval Service - 7

3. In-House Library Staff member goes to outside Library for copy or retrieval - 2

4. First check Westlaw/Lexis for available - 2

5. In-house messenger assigned to Law Library only for these types of requests and also does shelving/filing. - 1

6. Place requests through in-house library staff and they, in turn, request through outside library copy/retrieval service - 3

A few commented that it is less expensive to use the outside libraries copy/ retrieval service than a paralegal going over considering traffic, parking costs, mileage and the billing of their time on top of the copy costs.

Concern has been expressed over the copying of an entire chapter of the book.

The copying of even a full chapter may be justified as fair use. In Sony the Supreme Court permitted the copying of an entire work to be fair use - as occurred in Williams & Wilkins before that time, and several cases since. The fair use question is decided by consideration of four very broad factors, outcomes are not predictable in advance. Certainly a good faith argument can be made that copying a chapter for educational purposes, even if by a profit-making company could be fair use. However, the persons doing or requesting the copying ought to take into account (and advise their principals) that in case a litigious publisher decided to make an example of the case, a lawsuit could result as to which the outcome would be unpredictable, and while damages would be small, the copyright act permits courts to grant statutory damages, and, more significant, real court costs against the loser.

In light of the repeated expansion of the period of copyright protection far beyond anything that could have been anticipated by the founders who required that copyright monopolies should be for a limited time, an aggressive attitude toward fair use seems the right attitude for consumers. Perhaps, however, a relatively public forum like this is not the best place for making requests which test the good faith limits of fair use (not that a single chapter on a single occasion is necessarily such a case). It would be well if requests for copies routinely added a remark about paying costs (including copyright fees if applicable) MJL
