I am looking for a U.S. Army regulation dealing with adjutants general for
the National Guard that once appeared in C.F.R. but was deleted in 1978.
In 1977, 32 C.F.R. 564.1(f) read as follows:
(f) State adjutants general. The appointment of the
adjutant general of a State
and his tenure of office are governed by the laws of the
state. . . . A State adjutant
general may be appointed and serve in that capacity without
Federal recognition. . . .
June 20, 1978, 43 Fed. Reg. 26443 deleted section 564.1. The Summary states
that these regulations "do not have sufficient impact on the public to
warrant publication in the Federal Register and Code of Federal Regulations.
.. . [t]his deletion does not revoke or cancel the Army regulations
concerning the same subject information."
So, I am trying to locate the Army regulations concerning the same subject
matter as that covered in 32 C.F.R. 564.1(f).
I have tried Internet and Westlaw searches of the U.S. Code and C.F.R. I
have tried Internet searches of numerous military sites, including the
Adjutant General's Office. I located one Government Document that might
contain the regulations, but I am unable to find this document locally. The
SUDOC number and title follow:
D 101.20/4:12-42 II-MQS Military qualification standards II : Adjutant
General Corps BC no. 42, adjutant general. It is a 1 volume loose-leaf
published in 1986.
If anyone knows where/whether the regulations exist, I would be very
grateful to receive them as soon as possible. If the information is
available, I must get it to the judge by Wednesday, so I don't have time for
traditional ILL methods to see if the document above contains the
regulations.
