Thanks to all who quickly responded to Tuesday's alert to contact members of
the House Commerce Committee urging support for the Klug-Boucher amendment
on fair use. AALL members have been key for many months now in lobbying
House members for important library, education and consumer amendments to
H.R. 2281, the WIPO implementation bill. Now we need to keep up the good
work!
Chairman Bliley (R-VA) opened Wednesday's full committee mark-up by
announcing that the interested parties--the content community and the "fair
use community"-- had not reached agreement during negotiations on the
Klug-Boucher amendment. He added that the committee had received an
extension until July 21st for its deliberations. Bliley also strongly urged
the content community to reach an accommodation with us on the fair use
amendment. Rep. Billy Tauzin (R-LA), before whose subcommittee I testified
on June 5th, urged everyone to work hard to reach consensus because, as he
noted, "fair use is the major stumbling block" to getting the bill to the
House floor. Good news indeed for us!
H.R. 2281 was taken off the agenda and is now scheduled for mark-up on July
16th, giving us three more weeks to KEEP UP THE PRESSURE! We have made
substantial progress since the bill was referred to the Commerce Committee
but we need to continue our efforts to ensure that we WILL get a fair use
amendment added to the WIPO bill.
Below is a list of all Commerce Committee members, their phone numbers and
the name of the staff person covering H.R. 2281. If your representative is
on the committee, PLEASE contact their office by phone or fax RIGHT AWAY to
urge their support for the Klug-Boucher fair use amendment. If your
representative's name is preceded by an *, they are already a co-sponsor of
the Boucher bill that includes a strong fair use provision, but they need to
hear your appreciation and thanks.
As law librarians, we are in a powerful position to explain a very complex
issue to a staff person who may have little understanding of technology,
much less the complexities of copyright law. What we're finding, though, as
we contact congressional staff, is that many members of the Commerce
Committee have not yet heard from their constituents. If we are to succeed
in this critically important endeavor, help from each and every one of you
is crucial.
