The transcript of the February 6, 1997 hearing before Judge Friedman
has been posted on HyperLaw's Web site - http://www.hyperlaw.com.
Since the hearing, HyperLaw has filed an amended motion to intervene
for appeal and other purposes and DOJ filed a motion to request the
Court to approve the consent decree.
HyperLaw believes that the Department of Justice, by witholding
documents and information required to be made public under the Tunney
Act, puts the court in the position of being asked to approve a
consent decree while the parties conceal material information from
the court, as well as the public. The Tunney Act was passed to keep
the Department of Justice from doing exactly what it is doing here.
The Department of Justice, also, seem to be saying that, good or bad,
the deal it struck with West and Thomson last June is a deal, and DOJ
will not welsh, no matter what the public comments disclose or
question and no matter that DOJ may have been deceived into entering
into the deal in the first place.
