The article to which you refer is inaccurate as to its suggestion
that the judge refused to approve the terms of the merger.
As I stated in a law-lib posting on December 23:
"The judge did not reject the merger, nor could he have, since the
merger was consummated a long time ago without objection by DOJ."
The judge rejected the deal that DOJ and Thomson made las June when
DOJ elected not to oppose the merger. However, the merger proceeded
-- DOJ could have, but did not, hold up the merger until the consent
decree was approved by the judge. So, now DOJ is sitting with no
deal and having let the merger go through.
