I have been asked to query my Australian colleagues regarding the procedural
issues involved in giving a deposition in Australia (by a voluntary witness
who is not a party to the action) for use in an Amercian (specifically,
Virginia) court. Does Australia allow the giving of depositions within its
bounderies for use in a foreign country, and does Australia participate in
both the Uniform Foreign Depositions Act and the Hague Evidence Convention?
We want to avoid any glitches in the approval and transit processes, so any
guidance on these issues is also appreciated. We have checked our own
resources to research this, but my attorney is eager to hear it "from the
horse's mouth" and wants to leave no stone unturned.
