A bill pending in the Illinois General Assembly could radically alter the
abilty and willingness of libraries to participate in interlibrary loan.

Senate bill 1036 would amend the Criminal Code of 1961 to specify that
the comtemporary community stardard to be applied in determining
whether material is obscene is the adult community standard IN THE
COUNTY IN WHICH THE MATERIAL IS SOLD, DELIVERED, OR
ADVERTISED. Providing materials on interlibrary loan presumably would
constitute delivery.

This measure has already passed the Illinois Senate (in May 1995).
Yesterday a heaing was held before the House Judiciary Committee.
The library community presented testimony is opposition to this bill. Bob
Doyle of the Illinois Library Association appeared before the committee.
He included in his testimony a statement provided by the Chicago
Associaiton of Law Libraries (CALL) specifically addressing concerns
of law libraries. The committee voted nine to six in favor of this measure.
 It now moves to the House floor for a vote.

Illinois librarians and other interested parties are urged to contact their
state representatives to ask the lawmakers to vote against this bill.
Please call or fax your rep's Springfield office and urge a vote against
Senate Bill 1036.

Action is needed now. This Illinois House will change party control in
January, and there is a major effort to push through legislation before the
change.
