On July 5, 1996, DOJ published in the Federal Register a Competitive
Impact Statement concerning the proposed Thomson/West consent decree.
This is avaiable from the GPO site, or it may be found on HyperLaw's
Web Site --- www.hyperlaw.com.
The statement was filed with the US District Court in the District of
Columbia and in essence is DOJ's justification (or rationale) as to
why the Court should approve the settlement and consent decree at the
September 30, 1996 hearing.
One thing missing is how the list of divested products was developed
-- other than a few of the products, it appears that Thomson and West
were permitted to come up with their own list of less profitable
products to produce a nice round number of products to include in the
press releases.
The Statement also establishes that West was always blowing hot air
when West claimed it would license star pagination to anyone. DOJ
says that West had only two star pagination licenses -- it does not
identify those two licenses, but it is public knowledge that Lexis
obtained a license as part of the 1988 settlement, and last year West
issued a press release trumpeting a license to a small publisher,
Juris, who star paginates 50 or so black lung disease opinions per
year.
Now, if DOJ would only force full disclosure of the all of the
anti-competitive 1988 agreements between West and Lexis, the public
may learn even more of this sorry story.
