Section 12A, Hatch Act -Reply

Mary, I have looked under Hatch Act in the USCA popular name index,
and then at our Statutes at Large. There is the "Hatch Act of 1887,"
and also the "Hatch Political Activity Act," from 1939. I am not
sure which one you are referring to.

It does not seem like the initial "Hatch Act of 1887" or the
subsequent changes made to it in 1955 included a section 12A. The
"Hatch Act Reform Amendments of 1993" (Public Law 103-94) does
include a section 12A, dealing with effective dates of this act. The
cite is 107 Stat. 1011.

If you are referring to the "Hatch Political Activity Act," again,
the initial act did not include a section 12A. The first changes
made to it in July of 1940 (54 Stat. 767) did include a section 12A,
which deals with interference with an election by certain State
Officers or Employees.

I hope this helps. Please let me know if you need me to fax any of
these to you.

Thanks :)
