This message is a follow up to the one I posted yesterday concerning the
Ohio Premise cd-rom from West covering Ohio cases and which was
apparently missing cases reported in the Ohio Miscellaneous series.
After discussing the issue with an editor at West, I'd
like to report that there are indeed cases not included on the cd-rom
that are reported in the print version, and although this fact is stated
on the "scope" screen, it is not entirely clear what cases are and are
not included from the Ohio Misc. series. What are reported are "decisions
from miscellaneous Ohio courts of record reported in Ohio Misc. v. 10
through Ohio Misc.2d v. 74 p. 176." What are not reported are the
district court decisions from the Northern and Southern districts of
Ohio and the 6th circuit opinions reported in Ohio Misc. The cases
included on the disk are taken from the Ohio cases database on Westlaw
which does not contain any federal cases (these are contained in the
federal caselaw database).
Apparently beginning with Ohio Misc. 2d federal court decisions are no
longer included in the print reporter. I made this determination by
looking at the title pages of some Ohio Misc. volumes and compared
them with title pages of Ohio Misc. 2d volumes. Starting with 1 Ohio
Misc. 2d, the title page changed from "Reports of selected cases argued
and determined in the courts of and in Ohio..." to "Reports of
Miscellaneous cases argued and determined in the courts of Ohio."
In any event, please be aware that the federal cases reported in Ohio
Misc. are not included on the Ohio Premise cd-rom. The editor
with whom I spoke seemed to believe that the scope page could be revised to
make this fact more apparent. This clarification would undoubtedly
result in a more useful description of the contents of the disk.
I would also like to thank the people at West for their prompt attention
to this matter, especially Matt Gilson who took the time to call me
personally to discuss my questions.
