Judge Magnuson in the oral argument of Oasis v. West on April 26,
1996 (see transcript on HyperLaw Web site) said at the conclusion of
the argument:
"I suspect, while in candor (sic), I'm simply a whistle stop on the
way to
the Circuit; but that is all right. That is my job."
True to his word, Judge Magnuson on Friday, May 17, granted the West
motion for summary judgment and dimissed the Oasis claim challenging
West's copyright in citations.
Seems that the Court did not even blow its whistle, but just waved at
the West train roaring by.
The case is on Westlaw and is not yet on Lexis.
In the meantime significant parts of the record are under seal ...
which makes one wonder what the record on appeal will look like.
