Any assistance in locating the correct Bahamian statute
would be appreciated. One of our law clerks has a portion
of the Bahamas recording act; it states that with some
exceptions, real property transfers may be recorded.
However, it says nothing about the effect of recording re:
notice, bona fide purchasers, etc. Is the Bahamas a
"race-notice" jurisdiction? Does English statutory and
common law (in the absence of Bahamian authority) control
the question?
Thanks in advance for any help that you may be able to
provide us. We will, of course pay, any costs associated
with sending the correct statutes to us.
