Subject: Ethics and the Internet

I am gathering materials relating to the ethical requirements in the
various states relating to Internet use by attorneys and law firms. My
research is to help me prepare some materials for a conference sponsored by
the State Bar of California this May.

The main issues I am focusing on currently are the regulation of Web Page
Sets (ie, home pages), and confidentiality and unauthorized practice of law
issues associated with attorney email use. To date, in addition to
collecting articles from the Internet, I have been contacting various state
bars across the country to determine whether they have established or are
establishing requirements for attorneys and their use of the Internet.

        I plan to share the fruits of my research, probably by publishing a
        summary on my home page (URL below). I would appreciate references
        to relevant resources if you know of any.

        The three main topics of concern are:

1. Email use and the waiver of confidential communications. There are
few, if any, opinions addressing this issue. There are some dealing with
waiver as it relates to cellular telephone use, for example.

2. Advertising/solicitation restrictions associated with the
publication of a Web Page Set.

3. Unauthorized practice of law, focusing on attorneys practicing out
of their jurisdictions through email communication.

        I would appreciate it if you could EMAIL ME DIRECTLY any of the
        following information relating to these topics:

1. A contact at a state or local bar assocation who would be in a
position to know whether that state/local bar had or was developing
Internet ethical standards.

2. A copy of a local or state's rules of conduct/disciplinary rules
relating to one of these topics.

3. References to bar ethics opinions or caselaw.

4. References to law journal or other publications with articles
dealing with the topics.
