I am happy to hear that Rita Reusch will be attending the session: in an
earlier message, she had stated that :"Inasmuch as I will be a participating
committee member, I will not be
presenting at the hearing." I read it too quickly and assumed she meant she
would not be "present".

As far as a national effort to establish "uniformity", it seems to me that the
<primary> goal should be not uniformity, but an immediately available citation
of the opinion and the location within the opinion. After all, there is far
less uniformity now than many would like to believe. To say that uniformity
should not be the primary objective, does not mean I support random chaos. The
Lousiana system is different from the South Dakota system, but they are uniform
in the sense that both are "official" citations sanctioned by the court. I
think that no great disaster would occur if South Dakota and Louisiana never
had uniform citations -- the legal system would accomodate quite easily.

I also hope that those from smaller states will not press upon larger complex
court systems solutions that are easier to accomplish in smaller states or
jurisdictions with fewer levels and branches and that where there are not a
great number of unpublished opinions.

In that regard, I beleive it would be appropriate to have a thoughtful response
by the AALL to the points raised by Mr. Muller in his dissent. I understand
that he will be a the November 8 meeting.

I also hope that the AALL will provide to the ABA the 16 or 17 comment letters
that I understand were received in response to the March, 1995 draft of the
AALL Task Force.

Re Alan Sugarman's suggestion that I share information about the
progress of Louisiana's Public Domain Citation format with the ABA's
Committee on Citation Issues--I did indeed submit a fairly substantial
packet of information, including a copy of Chief Justice Calogero's
presentation at the AALL National Conference in July. My cover letter
assured the committee that Louisiana would be happy to cooperate with a
national effort to establish a uniform public domain system.
Fortunately, Rita Reusch, Chair of AALL's Committee on Citation Reform,
is our liaison to the committee and will be attended its meeting in
Chicago, Dec. 8-10. Rita has been assured that she will have an
opportunity to present AALL's position and experience directly to the
other committee members. They were already in possession of documents
submitted by Lynn Foster, Rita Reusch and me over a number of months as
we stayed in touch with the Chair, J.D. Flemming. Carol Billings
