Hi,

We are trying to find a a copy of a case from the Appellate Court of Dusseldorf (Germany) for which we unfortunately do not have a case name, number or date, although we believe it is fairly recent. All we have is the following brief description:

The Appellate Court of Düsseldorf allowed that producers can be subjected to an action by their competitors for unfair competition under German law for failure to comply with the RoHS(Restriction of Hazardous Substances - an EU regulation) registration requirements. In addition to enforcement by public authorities for fines and compliance orders, and actions for damages by customers, this decision allows for the possibility that sanctions for non-compliance could include an injunction to prevent non-compliant producers from placing further products on the market.

Does anyone have any suggestions on how to track down this decision? We searched Lexis and the web generally for sources that might link to the case but did not have any luck. We also found the court website.

Thanks for any help you might be able to provide.

Linda Dean
