Contracts (cite is in Vol. 5)
Hello everyone -
My local ILL resource does not have the volume I need (5th volume,
Revised Edition), so I hope that someone has the following:
"If, however, the plaintiff has only partly performed and has been
excused from further performance by prevention or by the repudiation or
ABANDONMENT of the contract by the defendant, he may recover, either in
England or the American, the value of the services
rendered.....Williston on Contracts, Revised Edition, Vol. 5, Sec. 1459,
pp. 4076-7."
Cite taken from: In North American Graphite Corp v Allan, 184 F.2d
387 (1950), in a footnote at the end
I am aware that the quote is still in Williston (4th), but the attorney
would like to see the cite as printed in the Revised Edition (date
unknown, though prior to 1950, and cannot determine for sure via
FirstSearch).
If someone would be so kind to e-mail me a copy of these two pages, I
would greatly appreciate it!
