Hello all,
I'm looking for a cite from a superseded edition of C.J.S. in which
Section 584 subsumes page 438. The historic cite is:
32 CJS Evidence section 584, p. 438
and should include the following text:
"An issue as to the existence or occurrence of particular fact,
condition, or event, may be proved by evidence as to the existence or
occurrence of similar facts, conditions, or events, under the same, or
substantially similar, circumstances."
I'm not sure what edition C.J.S. contains this language and pagination,
but one contemporaneous case was reported in 1947. If anyone can
provide a scan or facsimile, we would be more than happy to compensate
for your time and expenses.
