I am trying to locate a copy of the following cited treatise page: 1
Phil. Ev. 169.
No edition number or publication year is given, but this citation
appears in an 1840 Arkansas Supreme Court case in the following
sentence: "Thus, upon an indictment for murder, former grudges and
antecedent menaces may be proved to show the prisoner's motive against
the deceased, 1 Phil. Ev., 169; Ros. on Ev., 71."
Our library owns S(amuel) M(arch) Phillipps' A treatise on the law of
evidence, 10th English edition (1859), as well as the third edition of
Phillipps's A treatise on the law of evidence, 6th American edition from
9th London edition (1849-1850). But, we do not own any edition that
predates the 1840 Arkansas case.
If anyone has a pre-1840 edition of the Phillipps treatise, we are happy
to reimburse for the cost of faxing page 169 to us.
