I have been asked to find whatever materials are publicly available from
administrative agency records regarding pollution exclusion clauses in
commercial general liability insurance policies.
The attorney is particularly interested in the process required of an
insurance company to include a "total" or "absolute pollution exclusion"
clause in an insurance policy and any documents an insurance company
would have to submit to a state agency that regulates insurance
companies discussing or defining "pollutant". He is not interested in
case law, because he is already reviewing that resource. He is more
interested in learning what goes into the generation of a pollution
exclusion clause so that it may appear in an insurance policy.
Information from any jurisdiction will be appreciated.
I have spent some time looking at the Massachusetts Division of
Insurance website, but have not found anything, yet.
