Attn NM librarians - looking for old New Mexico law! - help pardon Billy the Kid!

Hey New Mexico librarians -

Because of a posting I made a couple of years ago, my name came up on a search done by this gentleman. I told him
I would post this for him. This is certainly an interesting question, and if you can help him, as he says, you'll be part of solving a modern CSI-type drama!
If you reply directly to him, please do copy me, as I am interested in following this thing now.

Thanks!

Susan,

Here is what I am looking for. Section 40 of the New Mexico law
somewhere like 1879 or before says that the county commission can appoint
someone to fill the post if the elected official is dead, quits, or
leaves office. What we are doing (believe this or not) is working a case
where William H. Bonney is a suspect (Yeah, Billy the Kid). We are
looking at the escape of Bonney from the Lincoln County Jail and the
shooting of two guards. This case is 123 years old, but we felt we could
put more light on this with modern CSI. It has sparked a fire that has
traveled around the world and has been in every newspaper on the planet. History Channel has done a story about the case and is now following us
filming for another TV. So we want to close this by late summer. Our
Governor is going to hold hearings on this case and may give Billy the
Kid a pardon (which means nothing to us but it is good press I guess). We are close to putting this to bed but have been looking everywhere for
Section 40 of the law. That is all we know it by and have found it in
some original doc's that we have unearthed.

So now that you know you are dealing with cowboy cops that are working on
the most famous jail break in the history of the west and that me must be
somewhat nuts. What do you do? Can you help us find this section of the
law? Thanks for getting back to us.

Steve
