Greg,
I haven't had this happen with ABA./BNA but I have had it happen with PLI.
The attorney attends a CLE program and is given a course book. I don't
know if the attorney later gets a letter about supplementing but I have had
several attorneys send me the invoices for supplements to course books.
Like in your situation, the invoice is sent directly to the attorney under
his name. Often I don't get the supplement and/or invoice until it is too
late to do anything about it. When I called PLI about it they said the
attorney was on a standing order to receive the supplement but the
attorneys swear they never ordered anything.

I'd also like to know about the legality of this practice.

Some of our attorneys that are members of the ABA Health Law Section were
sent supplements by BNA for Health Care Fraud and Abuse: Practical
Perspectives. without asking for them. Here's the story according to BNA:

>From what I was told, earlier in the year the ABA provided members of their
Health Law Section with "free" copies of the main treatise. A BNA rep that
they were "given" the list of people that received the treatise by the ABA
and then BNA subsequently sent a letter to all of these people saying
"unless we hear differently from you, we're sending you a supplement" or
something along those lines. Our attorneys I'm sure ignored this
communication it and... Presto! We now have multiple shipments saying
"here's the book you wanted. $115 please."

Am I wrong or they not allowed to do this? Anyone else have this happen? It
may have and you might not know about it as these shipments were directed
right to the attorneys. Ours were accidentally sent to the Library by our
mailroom.
