Judi, I apologize. After exhaustive reading of 445 U.S. 169, I noticed that it defines an "agency" at page 179. It seems impossible to obtain the records from the professor (individuals are exempt from the act). Also, it seems receiving federal funds does not automatically bring an entity under the act (643 F 2d 1369, 1373).

Subject: FIOA Requests for Academic Research?
Has anyone out there ever heard of someone using a FIOA request to obtain raw research data from a public university professor? The data was financed through a department of the school (which is at least partially funded by the federal government) and not through a federal grant.
I have researched the issue extensively and although many interesting angles came up, I couldn't answer the question definitively. I have looked at 445 U.S. 169/P.L. 105-277/OMB Circular A-110/ 1999 FR 5684 .
