The 2003 edition of our Federal Civil Rules Booklet is now available for immediate shipment. The Booklet contains the fully updated Federal Rules of Civil Procedure (including the integrated amendments summarized below), the fully updated Federal Rules of Evidence, as well as the fully updated federal jurisdiction, venue and removal statutes (28 USC §1330 et seq.).
The following amendments to the Federal Rules of Civil Procedure became effective December 1, 2002.
New Rule 7.1. Disclosure Statement. The new rule requires each non-governmental corporate party to file a disclosure statement stating whether it is owned by a parent corporation and, if so, identifying the corporate parent.
Rule 54. Judgments, Costs. The amendment deletes the requirement that motions for attorneys fees be served within 14 days after entry of judgment and deletes the requirement that judgments on motions for attorney fees be set forth in a separate document.
Rule 58. Entry of Judgment. This rule is essentially rewritten. Among other changes, the amended rule deletes the "separate document" requirement for orders disposing of motions listed in Appellate Rule 4(a); replaces the definition of when a judgment becomes "effective" with a new provision that defines the time when judgment is entered; and deletes the provision that attorneys shall not submit forms of judgment except on direction of the court.
Rule 81. Applicability in General. The amendment deletes the return time provisions for writs of habeas corpus (such provisions already exist in the Rules Governing §§ 2254 and 2255 proceedings) and deletes the requirement that the writ be directed to the person having custody of the person detained (such requirement is already addressed in the Rules Governing § 2254 and § 2255 proceedings).
See our web site www.legalpub.com for the full text of all the changes to the F.R.Civ.P.
Additionally, the Multiparty Multiforum Trial Jurisdiction Act of 2002 made amendments to Title 28 adding § 1369 (Multiparty, multiforum jurisdiction) and changing § 1391 (venue), and § 1441 (removal jurisdiction).
The Booklet is still about half the price of other publications and by far the earliest available with the updated integrated rules and code. (Other publications do not provide updated integrated rules and code until April or May!)
