Hi,
Have you encountered variation in the contents of different printings or
editions of the early U.S. Reports? According to a citation one of our
law journal students is attempting to verify, a concurrence by Justice
Baldwin (who had some difficulty getting his opinions to the reporter in a
timely manner) appears ony in the Banks and Brothers edition of the
Reports and not in the DeSilver, Thomas, and Co. edition. All of our
copies, however, are the latter.
The case is Poole v. Fleeger, 36 U.S. (11 Peters) 185 (1837). If any of
this footnote is correct, the concurrence cannot be more than about a half
page long and has to be on page 212, or else the printing that has it
would cite differently for every later case in the volume.
If anyone either has encountered this problem before, or has Banks and
Brothers U.S. Reports to look at without too much trouble, please let me
know.
