I don't think New Jersey has a statutory law on the subject. As in many
states, common law prevails. Perhaps these cases can steer you in right
direction (Aspinall Mfg. Co. v. Gill, 32 F. 697 (D.N.J 1887);Misani v. Ortho
Pharmaceutical Corp., 210 A.2d 609;Ingersoll-Rand Co. v. Ciavatta, 542 A.2d
879). This is by all means not a legal advice.
