You are basically correct in your assumption about the availability of
comment letters requested on proposed rules in the Federal Register and
summaries of them in the final rule. However, if you want to get all the
comments (in their entirety) on a proposed rule you should submit a FOIA
request for those comment letters (or e-mails) citing the Docket number the
agency assigned to the rule.

Would some knowledgeable, generous subscriber out there assist in helping
clarify a few points in regards to comment periods in the Federal Register.
I know just enough to get me into trouble. Specifically, I am trying to
gather all the comments filed for the HIPAA regulations, for 45 CFR 146 and
148. What the requester wants are the comments given in response to the
request for comments, I would think from 62 FR 16958.

In general, I assume that:

--the agency is not required to make public all comments, at least not in
the FR, it appears there is a viewing period for the public at their
offices at some point

--the agency often summarizes the comments and does not make them public
verbatim in the FR
--the comments would usualy be in the FR with the final rule

Any clarification on these assumptions would be greatly appreciated or, if
one knows of a specific comprehensive manner to gather all the comments on
specific CFRs that would be helpful to. Thanks so much,
