On Friday 03 May 2002 the Full Court of the Supreme Court Of Victoria
granted British American Tobacco leave to appeal against the
interlocutory judgment of Eames J striking out its Defence for failure
to give true discovery and/or destruction of relevant documents. An
order for an expedited hearing of the appeal was also made, and the
appeal is likely to be heard in late July or early August.
