Re: Aron @ Associates - Just What *Is* Mark A Montgomery Raving About ?

Maybe I'm missing something, but precisely *what* has this got to do with (a)
law-librarianship, (b) matters related to law-librarianship or (b) legal
research ? If you, Mr Montgomery, really *must* rant about the alleged improper
tactics of a firm of attorneys, wouldn't the relevant Bar Association be an
infinitely more appropriate body to rant to - rather than this List ?

Subject: Aron @ Associates

Be advised that my recent experience with Aron @ Associates of Tucson,
"Arizona's Collection Law Firm" was so bad that it brings our view of the
entire law industry down substantially. These guys are worse than any
complaint that I've seen about publishers, software companies, or any
other business I've engaged with in over 20 years.

They represented a client on a perfectly legit loan that we didn't object
to but couldn't pay at the time due to investor issues beyond our
control. They then attempted to place a lien on our house which while not
allowed under AZ law (according to numerous bord certified attorneys),
they filed anyway. They then proceeded to summons me and my wife to
explain to a country judge the very complex issues in venture capital
financing that led to our innability to pay the unsecured note. I have
absolutely nothing to hide, but negotiated the sale of part of the
company anyway to get this parrasite off of us so we can get back to work
and produce something positive for society.

Once paid in full, they lied to me about when they canceled the summons,
yelled at me on the phone not to tell them how to practice law (I just
followed the Judge's clerk counsil on how to proceed), and then finally
sent me a letter as follows:

Dear Mr and Mrs Montgomery,

I have exciting news, so please read on. My client has requested that I
contact you to discuss the possibility of settling ...... (clip) by 25%
to 50%.

Signed Peer M. Balisino & Esther B. Simon.

These were loans we used our very complex business that I personally
guaranteed only because our investors were very wealthy, and we had
interest from senior reps in government, and a fair portion of the
world's largest companies. And I had no alternative at the time. I've
paid loans off my entire career, sometimes against the advice of our
attorneys. This is the first time in my experience, which includes
working for bankruptcy attorneys and many clients pro bono on management
consulting, that I've come across such a firm apparently in good standing
with the bar.

Needless to say, I don't have much respect for any organization that does
business with this type of firm and will avoid doing business with them
in the future. This type of company is in my view directly responsible
for the decline of our quality of life in the U.S., and it's shameful
that our system not only allows them to practice in this manner, but that
they are provided every incentive to do so.

My strong advice to the bar is to clean it up before the system is taken
down.

Kind regards,

Mark Montgomery

PS: The good news is that out of ten lenders we are currently paying off,
this is the only one that used these types of gutter tactics. The rest
were professional adults.
