HHS moved the waiver provision thirteen years ago to 42 CFR 488.54(c). They
made the change in 53 FR 22,850 (1988). I searched for "405.1910" in the FR
and found a reference to the change in 1991. See 56 FR 54539. (Note,
however, that a proposed rule in 1997, 62 FR 66726, still refers, like your
cross-reference, to the old reg!)
