I assume you are referring to the New Jersey "Consumer Fraud Act". If so,
It's doubtful if damages for pain & suffering would be allowed. Please see
Jones v. Sportelli, 166 N.J. Super 383, 390 (I did this about 5 years ago
and this is the case I found). Perhaps you can Shep./Auto-cite it to
determine the status or if other cases have cited it. This is not a legal
opinion.
