MCLE Rules

I would like to share some information regarding the change in the MCLE rules for California State Bar members and the California codes.

If you check the MCLE Rules and Regulations section of the Sate Bar Rules in Deering's and West's California codes, section 2.0, you will notice that they fail to list the new amount of hours required to fullfill their continuing legal education requirement. I notified both publishers on January 18, 2001 and there was some discussion on Law-Lib (I believe) as to what they had to say about it.

Today, I received a call from a Legal Analyst at Lexis and she explained that when Governor Davis signed the bill to change the amount of MCLE hours required, the bill only amended section 6070 of the Business & Professions Code, thus the State Bar Rules were not amended. She also informed me that this would be noted in the first legislative pamphlet for 2001. I have not heard from West, but, until the State Bar takes action, I think the State Bar Rules portion of the codes will remain as is. We are inserting a note to refer the reader to the B & P code.
