Today seems like I am up to my neck in alligators!! I would like to get
some help with another issue regarding the new Federal Rules of Civil
procedure.
One of my attys asked for the new rules, specifically Rule 26. I got a copy
from the USCCAN monthly advance pamphlet from July,2000 (No.5) at p. G135.
Then the attorney picked up a 2001 treatise with the new rules in it, and
just as far as Rule 26 is concerned, the wording is different. I have
looked at various versions, and have found both versions cited as "the"
rule. The version on Westlaw agrees with the USCCAN, as well as with House
Document 106-228. However, the rules on the Cornell website have the same
wording as the treatise, differing from these others.
If I've already missed the lawlib discussion of this, my apologies. If not,
could someone enlighten me???
