I am delighted that folks are checking the new article out. In the
interests of accuracy I want to point out that the web version cited is
a draft of the article, the newly published version is the final cut.
Not a lot of huge changes, but I did clean it up a bit and attempt to
bring it a bit up to date. It is worth thinking about that the printed
version came out over a year after the draft was available online. Law
review printing still lives in the dark ages of long delays.
