I am not certain of federal legislation on point, but at least in Colorado,
the legislature is considering passage of legislation which would require
that spammers append "ADV" (for advertisement) in the subject line of all
junk email and provide an opt-out email address to remove one's name from
the company's mailing list. The legislation is known as the Colorado Junk
Email Law, HB 1309, and can be found at:

are doing is not, in fact, spamming !!
Why not reply - specifically asking them for chapter and verse of the
legislation to which they are referring. I'll lay you a bet that your reply
will either "bounce" back to you undelivered, or be totally ignored.
Spam is spam is spam is spam.
Treat it as such, and delete it.
